These conditions apply to use of Council’s Portable Drink Fountain and Bottle Refill Units (Water Station) by an organisation or company (You).
1. Satisfy yourself before the Start Date that the Water Station is suitable for its purposes;
2. Use the Water Station safely and only for the intended purpose as described in the Water Station Hire Request;
2. Do not use the Water Station in connection with any political purpose such as campaigning or lobbying;
3. Indemnify Cairns Regional Council for all injury/ or damage cause or contributed to by You to persons and property in relation to the Water Station and its operation and have adequate insurance while in your possession to cover all liabilities associated with use of the Water Station;
4. Ensure that all persons operating the Water Station are instructed on its safe and proper use. Safety instructions can be found in the product guidelines;
5. Conduct a thorough hazard and risk assessment before use and comply with any health and safety laws relating to the Water Station and its operation;
7. Do not tamper with, damage or repair the Water Station;
8. Ensure the Water Station is returned when it is due back and in the same condition as when supplied, otherwise repair, cleaning or replacement costs may be incurred;
9. Report and provide full details of any incidents/accidents to the Water Station within 2 business days of the incident/accident or damage occurring and;
10. Accept that Council reserves the right to refuse access to the Water Station at its own discretion.
To the extent permitted by the law, Cairns Regional Council does not accept responsibility for any liability incurred by the use of the Water Station and any such liability is limited to the resupply of the Water Station.
Cairns Regional Council is not responsible for the provision of water bottles, the cost to provide water to the Water Station, unlocking taps that connect to the Water Station(s) or the cost of the water used by the Water Station.
