Application to waive Regulated Parking Penalty Infringement Notice (PIN)

Note: Applications must be lodged within 28 days of infringement notice.  Completion of this form in no way guarantees waiver of the infringement notice. Incomplete forms or documentation will result in your application being rejected.

In accordance with Section 22(1) of the State Penalties Enforcement Act 1999, the submission of a request to waive a Penalty Infringement Notice will not pause the timeframe to elect to have the matter heard before the Magistrates Court, being twenty-eight days (28) after the date of the infringement notice.

Invalid reasons

Council will not waive a fine for the following reasons:

  • Ticket not displayed on dashboard

  • Ticket upside down on dashboard

  • Did not see the signs or ticket machine

  • Expired ticket - not purchasing additional time to allow for unexpected delays

  • Did not pay immediately on parking (eg went to get coins from a nearby shop)

  • Parking in an accessible space without displaying a valid accessible parking permit

  • Commercial parking loading zone - not displaying a valid commercial vehicle permit from Cairns Regional Council

  • Continuous parking - vehicle parked longer than the time limit specified

  • Bus zone - vehicle not classified as a bus

  • Taxi zone - vehicle other than a taxi

  • No parking anytime zone - stopping for longer than 2 minutes and driver not present at vehicle

  • No stopping anytime zone - stopping on a road with a continuous yellow edge line

  • No stopping anytime zone - stopping within 10m of an intersection without traffic lights

You do not meet the criteria to request a review of your parking infringement.

Please pay your parking fee on time. Late payments will be sent a reminder notice and incur a standard late fee of $18.50. This fee may be higher if you are registered in another state or territory.

If you have not settled your infringement within 56 days, the matter will be referred to SPER (State Penalties Enforcement Register) with additional costs.
